Appeal and Operation

Below, you can find the rights to be considered in this process and the application steps:

• The family has the right to appeal each of the educational assessment and placement decisions once, within 60 days from the date the decision is communicated to them.
• Appeals are made to the Special Education Services Board within the affiliated Provincial/District Directorate of National Education. The Board evaluates the appeal within 30 days at the latest and provides a written response. The response is forwarded to the parent, the school/institution, and the Guidance and Research Center (RAM).
• If no response is received within 30 days, parents or interested parties may apply to the administrative courts.
• The Guidance and Psychological Counseling Services Execution Commission in schools and institutions conducts monitoring for at least 70 working days from the student's enrollment date. At the end of this process, if the decision for educational assessment, diagnosis, or placement is not deemed appropriate, an appeal process can be initiated with a request for re-evaluation.
• The Special Education Services Board may utilize relevant university departments and expert opinions on the subject while evaluating appeals.
• For the enrollment of individuals with special education needs in schools and institutions, it is not required that a placement decision has been made by the special education services board. However, the school/institution administration initiates the necessary official procedures for obtaining a placement decision for these students. If the school or institution where the student is enrolled complies with the placement decision, the student continues their education at the current school or institution. In the event of a different placement decision, the necessary procedures are carried out to transfer the student to a school that complies with the placement decision.
• Having acquired toilet training is not a mandatory condition for the enrollment of children of compulsory education age in daytime private special education institutions.
• For students attending special education practice schools, if they are absent for 70 school days without an excuse despite at least two written warnings issued by the school administration, grade repetition is applied.
  • Students who fail a grade due to absenteeism for two consecutive years may have their school registration canceled.
